Mexia man charged after child's death

    Christopher Mack, 22, of Mexia, is facing a charge of capital murder and an aggravated assault charge, following the death of a child, and the injury to another, in McLennan County.
    Mack was arrested Monday evening without incident in Mexia, and is being held in the Limestone County Law Enforcement Center (county jail) under $1.5 million bond. He will be returned to Waco, since the charges stemmed from Lacy-Lakeview in McLennan County.
    Mack had been on a two-year probated sentence since March, on a conviction for endangerment of a child, a charge lodged in Limestone County. Mack had been arrested in Mexia on May 17, 2007 on the felony endangerment of a child, and for evading arrest.
    The charges stem from the death of a five-year-old boy, Sinsear Kirvin, for whom funeral arrangements are pending at Pearly Gates Funeral Home, Highway 171 in Mexia. The second part of the charges against Mack stem from another boy, three, who was also beaten. Both children are from Mexia, and authorities in Lacy-Lakeview say both were in the care of Mack and  his girlfriend, Andrea Shante Thomas, 24 . Thomas was also arrested Monday evening, and is in the McLennan County jail in Waco, under a bond of $525,000.
    The victims were described as children of a couple from Mexia, and both the deceased and the surviving boy were said to be nephews of Mack, who picked them up in Mexia for the trip to Lacy-Lakeview, according to the arrest affidavit. The affidavit also said that Thomas was present during the beatings with a belt, and did nothing to stop the assaults. Nor did she seek medical attention for the boy.
    The five-year-old was dead before he was taken to Providence, the affidavit further stated.
     The tragic chain of events occurred Sunday night sometime before 11:30 at the apartment where Mack and Thomas live on East Crest Drive in Lacy-Lakeview. Mack, supposed to be “watching” the children for the Mexia family, caused serious bodily injury to the five-year-old, and to the three-year-old, according to Lacy-Lakeview Police Chief Dennis A. Stapleton. Andrea Thomas was present during the time of the alleged attacks, police say. The affidavit stated that an autopsy revealed cause of death as blunt force trauma. Another brother present is four, but was not injured badly enough to require treatment. Neither was a seven-year-old sister.
    All of the children live with their mother, Brandi Mack, in Mexia.
    Mack got a ride from a friend to the Providence emergency room, where the youngster was pronounced dead. The other child was placed into custody of Child Protective Services. The hospital notified the Lacy-Lakeview Police Department, which then became involved in the case.
    The child’s body was sent to the Southwest Institute of Forensic Sciences in Dallas, where the autopsy was performed. The three-year-old’s injuries are not life threatening, Chief Stapleton said. He was treated and released, although Lacy-Lakeview law enforcement is continuing its investigation.
